Terms of Service

1. Who these terms are between
These Terms of Service ("Terms") form a binding agreement between DishDash2GO ("DishDash2GO," "we," "us," or "our") and the restaurant, business, or individual that signs up for or uses the DishDash2GO platform ("Customer," "you," or "your"). By creating an account, connecting a WhatsApp Business number, or otherwise using the platform, you accept these Terms in full. If you do not agree, do not use the platform.
2. What DishDash2GO is
DishDash2GO is a software-as-a-service platform that helps restaurants accept and manage orders sent through Meta's WhatsApp Business Platform, plus optional kitchen, delivery, and analytics features. DishDash2GO is not a restaurant, food vendor, payment processor, or messaging carrier. We do not prepare, sell, or deliver food. We are an independent software vendor providing tooling to you.
3. Third-party services you must accept
The platform depends on third-party services we do not own or control, including but not limited to:
- Meta / WhatsApp Business Platform — for inbound and outbound customer messaging. Your use is also subject to Meta's and WhatsApp's own terms and policies.
- Stripe — for subscription billing and (optionally) customer payments.
- Amazon Web Services — for hosting, storage, identity, and notification infrastructure.
- Cognito — for authentication.
Outages, policy changes, account suspensions, message-template rejections, deliverability issues, or other actions by these providers can interrupt or change the platform without notice. You agree that DishDash2GO is not responsible for the acts, omissions, downtime, fees, or terms of any third-party service.
4. Your responsibilities
You are solely responsible for:
- The accuracy of your menu, prices, taxes, hours, fees, and any other content you upload or configure.
- Honoring orders accepted through the platform and complying with all applicable food-safety, licensing, labor, tax, and consumer-protection laws in your jurisdiction.
- Securing your account credentials, your Meta Business Manager, your WhatsApp Business Account, and any staff logins you create. You are responsible for all activity under your account.
- Obtaining and maintaining all consents required to message your customers under WhatsApp's commerce, business, and messaging policies and applicable communications laws (e.g. TCPA, GDPR, CCPA).
- Complying with all applicable laws when collecting, storing, and using customer data (including phone numbers, names, addresses, and order history) introduced into the platform.
5. Customer-facing kill switch — Meta authorization
DishDash2GO sends and receives WhatsApp messages on your behalf only while you have authorized our application inside your Meta Business Manager and assigned the relevant WhatsApp Business Account or phone number to us.
You may revoke that authorization at any time, for any reason, and without notice to us, by:
- removing the DishDash2GO system user, app, or asset assignment from your Meta Business Manager; or
- unassigning the WhatsApp Business phone number from our application; or
- deleting or suspending your WhatsApp Business Account directly with Meta.
Once authorization is revoked at the Meta level, DishDash2GO immediately loses the ability to receive or send messages on that number, and inbound WhatsApp traffic flows back to whatever device or system you have configured directly with Meta. You acknowledge that this kill switch is under your sole control at all times, that you can use it without our involvement, and that DishDash2GO has no ability to prevent you from using it.
You agree that the existence and continuous availability of this kill switch is a material part of the bargain between us, and that it is the primary remedy you should use if you believe the platform is malfunctioning, compromised, or otherwise causing you harm.
6. Service availability; no warranty
The platform is provided "as is" and "as available." To the maximum extent permitted by law, DishDash2GO disclaims all warranties, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or freedom from defects, errors, viruses, or vulnerabilities.
We do not warrant that the platform will be uninterrupted, secure, error-free, or free from loss of data; that messages will be delivered on time or at all; that orders will be received, parsed, priced, routed, or fulfilled correctly; or that any AI-generated reply, suggestion, summary, or insight will be accurate, appropriate, or suitable for your business.
You are responsible for monitoring orders and conversations through the dashboard and for catching errors before they affect customers. The platform is a tool, not a replacement for human supervision of your restaurant.
7. Security incidents and vulnerabilities
We use commercially reasonable technical and organizational measures to protect the platform, but no software, network, or AI system is immune from bugs, defects, downtime, misconfiguration, or unauthorized access. You acknowledge and agree that:
- The platform may, at any time and without prior notice, contain bugs or security vulnerabilities, suffer outages, return incorrect data, or be the target of malicious activity by third parties.
- If you suspect that the platform is malfunctioning or has been compromised, your first and primary remedy is to revoke our access at the Meta level (Section 5), pause or cancel your subscription, and contact us at the support address below.
- DishDash2GO is not liable for any loss, damage, or claim arising from a bug, defect, outage, security incident, third-party intrusion, phishing attack, social-engineering attack, account takeover, or AI hallucination, except to the extent such liability cannot be disclaimed under applicable law.
8. Limitation of liability
Please read this section carefully — it limits what DishDash2GO can be held responsible for.
To the maximum extent permitted by applicable law, in no event will DishDash2GO, its affiliates, officers, employees, contractors, or suppliers be liable to you or any third party for:
- any indirect, incidental, special, consequential, exemplary, or punitive damages;
- any loss of profits, revenue, sales, customers, goodwill, business, anticipated savings, or business opportunity;
- any loss, corruption, or unauthorized disclosure of data;
- any cost of substitute services or workarounds;
- any failure of, error in, or unauthorized access to a third-party service (including Meta, WhatsApp, Stripe, or AWS);
- any chargeback, refund, fine, or penalty imposed on you by a payment processor, regulator, or platform;
- any harm caused by an AI-generated reply, suggestion, or automated action;
- any harm caused after you knew or should have known of a defect, outage, or compromise and did not invoke the Meta-level kill switch described in Section 5;
even if DishDash2GO has been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms or the platform, regardless of the form of action and whether in contract, tort, statute, or otherwise, is limited to the greater of (a) the total subscription fees actually paid by you to DishDash2GO during the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
9. Indemnity
You agree to defend, indemnify, and hold harmless DishDash2GO and its affiliates, officers, employees, contractors, and suppliers from and against any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) any content, menu data, or message template you submit through the platform; (c) your interactions with your customers, including any order, refund, allergen, food-safety, or delivery dispute; (d) your violation of these Terms or any applicable law, regulation, or third-party right; or (e) your failure to invoke the Meta-level kill switch in Section 5 after you knew or should have known of a defect or compromise.
10. Subscription, billing, trial, and cancellation
The platform is billed on a recurring monthly subscription through Stripe. Trial terms, plan tiers, prices, and order limits are described on the marketing site and in your dashboard at the time of signup. You may cancel at any time from the dashboard or by contacting support; cancellation takes effect at the end of the current billing period and fees already paid are non-refundable except where required by law.
We may change prices, plans, or features by posting an updated version of these Terms or the pricing page. Continued use after the change constitutes acceptance.
11. Customer data and privacy
Information about how we collect, store, and use personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
12. Suspension and termination by us
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or any third-party policy (including Meta's); if your account is past due; if your activity threatens the platform's security, stability, or reputation; or if continued service is no longer commercially viable for us. On termination, your right to use the platform ends immediately. Sections that by their nature should survive (including Sections 6–9, 13, and 14) survive termination.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the platform will be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts. Each party waives any right to a jury trial. Claims must be brought on an individual basis only; you waive the right to bring or participate in any class, collective, or representative action.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be communicated through the dashboard or by email. Continued use of the platform after the effective date of an update constitutes acceptance of the updated Terms.
